10. SERVICES

GO Broadway LLC does not issue refunds under any circumstances, and it may cancel, delay, or otherwise modify any and all portions of its programs and workshops in its sole discretion, including, but not limited to, reasons beyond its control such as weather, health, work stoppages, fires, war, government regulations, terrorist attacks, riots, pandemics, epidemics, travel problems, visas or any act of god and similar occurrences, and GO Broadway LLC shall not be liable for any such cancellation, delay or other modification. Because all of our programs and workshops are customized based on the students who are enrolled, once a reservation is confirmed, a cancellation is not possible. In the case that a GO Broadway LLC workshop is cancelled/postponed, the student can apply the credit paid to future programs or workshops.

In the event that the scholarship recipient does not attend the GO Broadway LLC program or workshop he/she was signed up for, the scholarship does not apply to future seasons of the program. In the case that a GO Broadway LLC program or workshop is cancelled/postponed, the scholarship recipient can apply the scholarship to future programs or workshops of the same price. The scholarship is not redeemable for cash. GO Broadway LLC is not responsible for travel arrangements or lodging that must be cancelled.

Students release GO Broadway LLC, its teachers, and employees from all claims, demands, losses, and liabilities whatsoever that applicants may have through the program or in the future in connection with any photograph and/or recording embodying some or all of their voice, name, or likeness, or their participation in the Competition or other events.

Any of the performances or appearances by applicants in connection with the programs, workshops, auditions, performances, or other events may be exploited by GO Broadway LLC, its team, and sponsors by any means and media throughout the world in perpetuity, including by streaming, radio (including satellite radio), and all other means of audio and audiovisual distribution now or hereafter known, for promotional, fundraising and advertising purposes. Applicants do not receive any compensation for their participation in any recording of the programs, workshops, auditions, or performances, or any exploitation of thereof as herein described, and by participating in these events, applicants waive any claims to any compensation.

11. COVID-19 LIABILITY WAIVER

While GO Broadway LLC is working closely with medical and public health experts and taking measures to enhance the safety of its visitors, artists, and staff, an inherent risk of contracting COVID-19 and other contagious diseases exists in any public space. In order to participate in any GO Broadway LLC program or workshop, all applicants are required to read and accept the following waiver.

By participating in a GO Broadway LLC program/workshop, I agree to comply with all health and safety protocols implemented by GO Broadway LLC, as well as all applicable federal, state, and local rules and guidelines, and I agree that:

GO Broadway LLC cannot guarantee that I will not be exposed to and contract COVID-19 or other contagious diseases, and all those entering the program/workshop do so at their own risk.

I accept the risk of being exposed to, contracting, and/or spreading COVID-19 or other contagious diseases along with all related consequences. I agree that this waiver means I give up all right to bring any claims, including but not limited to claims of negligence.

Participation in the program/workshop is conditioned upon compliance with health and safety protocols. Applicants who do not follow applicable protocols may be disqualified.

This contract will be governed by the laws of the State of New York.

En caso de que el becario no pueda asistir al programa o taller de GO Broadway LLC en el que se inscribió, la beca no aplica para futuras temporadas del programa. En el caso de que un programa o taller de GO Broadway LLC sea cancelado/aplazado, el becario podrá aplicar la beca a futuros programas o talleres del mismo precio. La beca no es canjeable por dinero en efectivo. GO Broadway LLC no es responsable de los arreglos de viaje o alojamiento que deban cancelarse.

Los estudiantes liberan a GO Broadway LLC, sus maestros y empleados de todos los reclamos, demandas, pérdidas y responsabilidades que los solicitantes puedan tener a través del programa o en el futuro en relación con cualquier fotografía y/o grabación que incorpore parte o la totalidad de su voz, nombre , o semejanza, o su participación en el Concurso u otros eventos.

11. EXENCIÓN DE RESPONSABILIDAD POR EL COVID-19

Si bien GO Broadway LLC trabaja en estrecha colaboración con expertos médicos y de salud pública y toma medidas para mejorar la seguridad de sus visitantes, artistas y personal, existe un riesgo inherente de contraer COVID-19 y otras enfermedades contagiosas en cualquier espacio público. Para participar en cualquier programa o taller de GO Broadway LLC, todos los solicitantes deben leer y aceptar la siguiente exención.

Al participar en un programa/taller de GO Broadway LLC, acepto cumplir con todos los protocolos de salud y seguridad implementados por GO Broadway LLC, así como con todas las reglas y pautas federales, estatales y locales aplicables, y acepto que:
